Prices in effect as of February 1, 2024

TRAVEL FEES:

Travel on your behalf — to your home, nursing facility, hospital, or other location $100 Winchester. Other locations, including Frederick County, $100 minimum or to be determined based on distance from my office.

Notary Travel Fee: $50 flat fee within Winchester; all other areas, including Frederick County, subject to distance.

 

LEGAL SERVICES:

Initial Consultation for each individual matter and estate planning or business planning checkup $100 for up to one hour. Missed appointments are $100.

Hourly rate — $400.

“Will” refers to simple wills.  If you have a more complicated document, as determined by Ms. Herskowitz, the price will be greater than what is listed.  Ms. Herskowitz will discuss this with you at the time of your appointment.

Durable Powers of Attorney (financial) $200/ Couple with reciprocal $375 for two

Medical directives $200 / Couple with reciprocal $375 for two

Medical directive & Power of attorney $375 / Couple with reciprocal $725

Two Wills, simple, no trust or other documents — $775

Two Wills, with testamentary trust, no other documents — $1100

Individual Will, simple, no trust, Durable Powers of Attorney and Medical Directives — $750

Individual Will, simple, testamentary trust, Durable Powers of Attorney and Medical Directives – $900

Wills, simple, no trust, Durable Powers of Attorney and Medical Directives for a couple — $1300.

Wills, with testamentary trust, Durable Powers of Attorney and Medical Directives for a couple –$1600.

Revocable Living Trust, individual, companion wills, no other documents — $1600

Revocable Living Trust, individual, companion wills, Durable Powers of Attorney and Medical Directives – $1950.

Revocable Living Trust including marital deduction planning, if necessary (one pot trust) companion wills, no other documents for a couple — $2200. Separate trusts for each spouse, additional $1000.

Revocable Living Trust including marital deduction planning, if necessary (one pot trust), companion wills, Durable Powers of Attorney and Medical Directives for a couple — $2800. Separate trusts for each spouse, additional $1000.

Irrevocable trusts are priced on a case by case basis. I do handle life insurance trusts, charitable trusts, special needs trusts. Average cost is $2000.

Trusts includes ONE deed for transfer of property. Additional are $100 each. Does not include filing fees.

 

REAL ESTATE SERVICES:

Deeds — $150 each; multiples may be discounted.

Deeds of Gift or other deeds of transfer are $150 each.

– If there are multiple lots or metes and bounds property description, additional costs may apply. Client must provide title information for all deeds. We may charge hourly to obtain information not provided by client. This may include telephone calls and travel to Clerks of Court; fax and photocopy fees additional.  If we have to review multiple deeds and plats in order to draft your deed, we will charge additional fees to review the documentation.

Deed of Trust and note – $400.

Subordination Agreement — $250.

Deed of Trust, note and subordination agreement package — $600.

Closings – In Virginia and West Virginia, I have relationships with title companies that I can recommend; I can prepare your documents for you and review your closing documents. Fee is based upon services rendered, usually paid as part of closing but fees are due regardless. Ask for further information.

 

BUSINESS AND CONTRACT SERVICES:

Business Formation, includes Articles of Organization or Incorporation and obtaining Employer Identification Number — $300. – does not include fees charged by the State, corporate record book, corporate record book updates, bylaws or operating agreement or partnership agreements.

Bylaws or Operating Agreement — $500; Simple for solo LLC $350.00

Partnership Agreement — $500, simple. Complex agreements and/or negotiations will incur additional fees to be determined.

Registered agent fee – $150 annually. Forwarding mail (other than official SCC mailings), answering queries from creditors and government agencies, telephone calls, and all matters regarding deliveries and summonses are at the hourly rate plus postage and telephone charges.

Contract Review, hourly rate — $100 minimum.

Contract Preparation — $300 minimum, total rate is dependent on what type of contract, negotiations necessary, other requirements to prepare.

PROBATE SERVICES: $400 per hour or guidelines as approved by Commissioner of Accounts or Fiduciary Supervisor. Retainer of $2000 or 2% of estate value, whichever is greater.

GUARDIANSHIP SERVICES: $400 per hour. Retainer of $2000.

 

MISCELLANEOUS:

Letters on your behalf, any type–$150 minimum charge, fee to be determined based on letter complexity.

Telephone calls, texts or emails on your behalf or with you — 0.1 of one hour minimum charge, subject to flat fee initial consultation. No weekend emails, texts, or phone calls except for planned appointments or emergencies — 0.2 of one hour minimum.

Consultation on your behalf with your accountant, bookkeeper, financial advisor, insurance agent or other advisor — hourly rate, subject to minimum rate for consultation, telephone or correspondence.

Fees — Copy fee 25 cents per page. All fees are passed on to client.

Paralegal fee: $50 per hour

Cancellation with less than 24 hours notice: $100.00.

Check, Cash, Visa, MasterCard, American Express, and Discover Card are accepted.

We impose a surcharge of 3% on credit cards, which is not greater than our cost of acceptance.
